These Terms and Conditions set out the basis on which Rubbish Removal Notting Hill provides rubbish removal and waste collection services. 1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

2. Scope of Services

Services may include collection of general household waste, garden waste, light construction waste, office waste, bulky items, and other non-hazardous materials, subject to assessment by the Company.

The Company reserves the right to refuse removal of any Waste that, in its reasonable opinion, is hazardous, illegal to transport, excessively heavy or bulky, or otherwise not suitable for standard waste collection. This includes but is not limited to asbestos, clinical or medical waste, chemicals, solvents, pressurised containers, gas bottles, illegal substances, and certain electrical or electronic items that cannot be lawfully transported or disposed of.

3. Booking Process

Bookings may be made by telephone, email, or through any other booking method the Company makes available from time to time. The Customer is responsible for providing accurate information at the time of booking, including the Site address, access details, description and approximate volume or weight of the Waste, and any other relevant information.

The Company may provide an estimated price based on the information supplied by the Customer. All estimates are given in good faith but do not constitute a binding quotation where the actual volume, weight, type, or accessibility of the Waste differs from the description provided at the time of booking.

In some cases, the Company may confirm a booking by providing a provisional time window or arrival slot. Any times given are estimates only and are not guaranteed. The Company will use reasonable endeavours to attend the Site within the agreed period but accepts no liability for delays caused by traffic, weather, operational issues, or other circumstances beyond its reasonable control.

4. Access and Site Conditions

The Customer must ensure that the Company has safe and reasonable access to the Site and to the Waste to be collected. This includes arranging any necessary parking permissions, loading access, or building entry requirements. If parking charges apply, these may be added to the final invoice unless otherwise agreed in advance.

The Company reserves the right to refuse to carry out Services if access to the Site is unsafe, obstructed, or significantly different from the description provided at the time of booking. In such cases, a call-out or cancellation fee may be charged to cover the Companys costs and loss of time.

The Customer must ensure that the Site is in a condition that allows the Company to carry out the Services without risk of harm to personnel, vehicles, or equipment. The Company may suspend or terminate the Services if it considers the conditions unsafe or not as agreed.

5. Pricing and Quotations

Prices will normally be based on factors such as volume of Waste, weight, type of Waste, labour required, access conditions, and disposal or recycling costs. The Company may provide price guides and examples, but the final price will be confirmed on inspection of the Waste at the Site.

Where a quotation is provided following a physical assessment of the Waste, that quotation will, unless otherwise stated, be valid on the day it is given. If the Customer accepts the quotation, the Services will be carried out as agreed, and the quoted price will apply provided that the Waste and Site conditions remain as assessed.

If additional Waste is presented for collection or the Site conditions differ materially from those on which the quotation was based, the Company may revise the quotation. If the Customer does not accept the revised quotation, the Company may charge a reasonable attendance fee.

6. Payments and Invoicing

Unless otherwise agreed in writing, payment is due in full on completion of the Services. The Company may accept payment by cash, debit card, credit card, bank transfer, or other methods it chooses to make available.

For business, commercial, or account Customers, the Company may agree alternative payment terms, including invoicing on completion with payment due within an agreed number of days. Any such arrangements must be confirmed in writing.

The Company reserves the right to charge interest on overdue amounts at the maximum rate permitted by law, together with any reasonable costs incurred in pursuing late or non-payment, including legal and debt recovery fees.

Title to any Waste removed passes to the Company only once full payment has been received, subject to applicable waste management regulations and duty of care requirements.

7. Cancellations, Rescheduling, and Waiting Time

The Customer may cancel or reschedule a booking by giving the Company reasonable notice. Where the Customer cancels or reschedules less than 24 hours before the agreed arrival window, the Company reserves the right to charge a cancellation fee to cover costs and loss of time.

If the Company attends the Site and is unable to carry out the Services due to lack of access, incorrect address, unsuitable conditions, or the Customers failure to be present where required, the Company may charge a call-out fee or a portion of the quoted price, at its discretion.

Where the Company is kept waiting at the Site beyond a reasonable period through no fault of its own, waiting time charges may apply. These will be notified to the Customer and added to the final invoice.

8. Customers Responsibilities

The Customer is responsible for:

Ensuring that they have the legal right and authority to arrange removal of the Waste from the Site.

Separating, where required, any items that must be handled differently, such as electrical items, recyclable materials, or items subject to specific disposal regulations.

Notifying the Company in advance if any Waste may be contaminated, sharp, unusually heavy, or otherwise presents a risk.

Complying with all applicable laws, regulations, and landlord or building rules relevant to waste removal and Site access.

9. Limitations and Exclusions of Liability

The Company will carry out the Services with reasonable care and skill. However, the Company shall not be liable for any loss, damage, or expense arising from:

Delays or failure to perform caused by events beyond its reasonable control, including traffic, road closures, extreme weather, accidents, or industrial action.

Pre-existing damage or defect to property, fixtures, fittings, or surfaces at the Site.

Indirect or consequential loss, including loss of profits, loss of business, or loss of opportunity.

The Companys total liability to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Services giving rise to the claim, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by the Companys negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be excluded or limited.

10. Damage to Property

The Customer must notify the Company as soon as reasonably practicable of any alleged damage to property caused by the Company while carrying out the Services. The Customer must allow the Company a reasonable opportunity to inspect the alleged damage and, where appropriate, to arrange repairs or other remedial action.

The Company is not responsible for damage where appropriate access has not been provided or where the Customer insists on removal methods or routes that increase the risk of damage. In such cases, any assistance provided by the Company is at the Customers risk.

11. Waste Handling and Environmental Compliance

The Company will handle, transport, and dispose of Waste in accordance with applicable waste management laws and regulations. This includes the duty of care requirements relating to lawful disposal, use of authorised facilities, and record-keeping where required.

The Company aims to minimise the amount of Waste sent to landfill by prioritising reuse, recycling, and responsible disposal, subject to the nature and condition of the Waste collected.

The Customer agrees not to present for collection any items that are illegally held, stolen, or otherwise unlawful to possess or transport. If such items are discovered, the Company may refuse to remove them and may notify the relevant authorities if required by law.

12. Prohibited and Hazardous Waste

The Company does not normally collect hazardous or specialist Waste, including but not limited to asbestos, chemicals, solvents, paint in liquid form, fuel, oil, explosives, clinical or biological waste, pressurised cylinders, and certain types of electrical or electronic equipment.

If the Customer is unsure whether an item or material can be collected, they must contact the Company before the booking or before the team arrives on Site. If prohibited or hazardous Waste is discovered at the Site, the Company may refuse to carry out the Services or may adapt the Services at its discretion and adjust the price accordingly.

13. Insurance

The Company maintains public liability and other relevant insurances appropriate for the nature of its rubbish removal and waste collection operations. Details of current cover can be provided on request. The Customer is responsible for arranging any additional insurance that they consider necessary for their own property or business.

14. Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of their concerns. The Company will investigate the complaint and aim to resolve it promptly and fairly.

Where appropriate, the Company may offer to re-attend the Site, provide a partial refund, or take other reasonable steps to address the issue. Any such remedies are offered at the Companys discretion and in full and final settlement of the matter, unless otherwise agreed in writing or required by law.

15. Data Protection and Privacy

The Company may collect and process personal data relating to Customers in connection with bookings, communications, invoicing, and the performance of the Services. This may include contact details, Site address, and payment information.

The Company will handle such data in accordance with applicable data protection laws and will take reasonable measures to keep personal data secure. Personal data will not be sold to third parties and will only be shared where necessary to provide the Services, comply with legal obligations, or enforce these Terms and Conditions.

16. Variations to Terms

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customers booking will apply to that booking. The latest version of these Terms and Conditions will be made available upon request.

17. Severability

If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of rubbish removal and waste collection services by the Company.

19. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the provision of the Services and supersede any prior agreements, understandings, or arrangements, whether written or oral. No variation shall be effective unless agreed in writing by the Company.
